Midway planning staff told the commission they discovered a contradiction in the municipal code that listed churches both as a permitted use and as a conditional use in the R-1-43 residential-agricultural zone.
“So what we'd like to do is just erase one of the lines that said it says it's a permitted use and leave it as a conditional use, which is the same for all other zones in Midway,” Michael, planning staff, said. Staff recommended deleting the permitted-use line and renumbering subsequent sections for clarity.
The commission opened a public hearing; no members of the public participated in person or online, and the hearing was closed. A commissioner moved to amend section 16.12.0.02g to remove the internally contradictory language and to adopt the staff-proposed findings. The motion was seconded and approved by roll call/voice vote.
What’s next: Staff will prepare ordinance language and renumber affected code sections for presentation to the Midway City Council.
