Committee approves favorable recommendation for license allowing Kukini MacKay Association to landscape county right of way

The Committee on Legislative Approvals and Acquisitions voted 6-0, with three absences, on Feb. 17 to give a favorable recommendation to Resolution 469-26, which authorizes the director of public works to issue a revocable license allowing Kukini MacKay Association Incorporated to enter, landscape and maintain a portion of county right of way along Kukini Highway.
The resolution, introduced by Council member Kimball by request, was discussed briefly during the committee’s meeting at the West Hawaii Civic Center. A staff member told the committee that, under county code, the committee must consult with HPD for items of this nature and that HPD had sent an electronic communication stating it had "no comment or no issue on this matter." The staff member said the electronic message had been received that morning but a physical copy had not yet been filed with council services and asked that the committee proceed and attach the hard copy at the next agenda.
Director Segawa, director of the Department of Public Works, said he was present to "speak in full support of this resolution number 4 6 9 dash 26" and thanked the association for "what this particular association is doing to beautify their frontage along Kukini Highway." Committee member Mister Eustace asked who had sent the HPD message; staff said it was from Chief Mahuna and reiterated that the paper copy would be filed for the record at a later date.
A motion for a favorable recommendation on Resolution 469-26 was made and seconded; the chair called the question and announced the vote tally as six ayes and three absences. The chair did not record individual yes votes; the minutes list Chair Inaba, Miss Villegas and Mister Kani Lee Kleinfelder as absent.
The committee concluded the meeting at about 12:34 p.m. The favorable recommendation forwards Resolution 469-26 to the council; the issuance of the license and any final terms remain subject to administrative processing by the Department of Public Works and filing of the HPD communication with council services.
