The Senate Committee on Labor and Technology on Feb. 13 recommended passage with amendments of SB2526, which would authorize rehiring retirees for positions considered "unique and critical to operations," with each rehiring limited to four years.
Director Young of the Employees' Retirement System offered comments but did not take a position. Deputy Attorney General Jenny Nakamoto urged clarifying the definition of "unique and critical" and suggested technical edits including a reference to chapter 76 and a prospective date. County leaders, including Mayor Bisson of Maui, urged a clear, specific definition: Bisson said the August 2023 wildfires demonstrated a need for experienced, returning emergency-management personnel and senior technical staff who possess institutional knowledge.
Committee discussion focused on drafting a precise definition. The chair said the committee would adopt the Attorney General's proposed amendments and language from the City and County of Honolulu's Department of Human Resources to define positions requiring a high degree of specialized knowledge and experience, and that the committee report would clarify the definition further. The committee adopted the recommendation by voice vote.
The bill moves forward with direction to refine the definition and to consider a sunset or prospective date as proposed by the Attorney General.
