Planning commission approves setback variance for backyard pool

The Dawson County Planning Commission voted to approve variance VA25-28, allowing construction of an in-ground gunite pool 5 feet from the rear property line.
Applicant representatives said the client recently purchased the lot and seeks the variance because of site constraints. "So we're applying for a variance to actually construct a, in-ground gunite pool," said Elijah Bowers, who identified himself as representing the applicant. No speakers appeared in favor or opposition during the public-comment period.
Under the county's Land Development Code cited at the hearing, the required rear setback is 20 feet; this variance reduces that requirement by 15 feet. Commissioners closed public input and approved the motion to grant the variance. The vote was recorded as carried with three votes in favor and one abstention.
The approval permits the property owner to proceed with permitting and construction subject to any building-permit and inspection requirements administered by county staff. The commission did not attach additional conditions during the public meeting.
