ESD finalizing rules to implement State WARN Act and updating registration‑for‑work WAC

Frazee said the department is working on rule language to implement what she cited as "Senate Bill 5525," the State WARN Act passed last session. The proposed rule clarifies how employee information received in WARN notices will be used to administer the Employment Security Act (Title 50). The department held a rule hearing in January and is finalizing a CR‑103 and supporting documents to adopt the rule, aiming to file within the coming week.
She also described draft rule language under section 7 of that statute requiring documentation for employers seeking exceptions to the notice requirement; the draft was posted and distributed via GovDelivery with a comment deadline of March 19.
Separately, Frazee said the department has filed a CR‑101 to update WAC 192‑180‑005 (registration for work) to better align rules with state statute and operational changes; comments on that filing were due March 13 according to the slide.
Committee members did not vote on rule adoptions during this meeting; Frazee invited questions and public comment on the posted drafts.
