The Sutter County Planning Commission approved a use permit for Diamond Elite Labor Services Inc. to store portable toilets and shade trailers on a roughly 3.62-acre parcel near the rural community of Sutter and the city of Yuba City.
Associate Planner Ravenna Soria told the commission the proposal would place outdoor storage behind an existing shop and use about 10,500 square feet of area on the north side of the property. "This project is a request for a use permit to allow for outdoor storage of portable toilets and shade trailers," Soria said. She said the parcel is zoned agricultural, is surrounded by rice fields on three sides and that no on-site cleaning or maintenance is planned.
Staff said the property, identified by assessor's parcel number 13-280-098 and listed at 5805 South Butte Road, would be screened from public view with fencing and landscaping, and access would use the existing gated driveway. An initial study prepared under the California Environmental Quality Act (CEQA) found no significant environmental impacts and staff prepared a negative declaration; staff recommended approval with the findings and conditions included in the staff report.
Commissioner Manuel asked whether his renting of adjoining rice fields would create a conflict of interest. "Is that a conflict of interest? I just don't wanna break an ethics code when I vote 1 way or the other," he said. County counsel responded that, based on Manuel's answers, "My opinion would be no."
Chair moved to approve the project consistent with staff recommendation; Commissioner Schmittel made the motion and Commissioner Manuel seconded. A roll-call vote was unanimous with Commissioners Schmittel, Manuel, Dasher, Marler, Stewart, Noor and Campbell voting "aye." The motion passed and the use permit was approved.
No members of the public spoke during the hearing; staff noted no letters of opposition had been received.
