Planning & Zoning recommends ordinance to limit restaurant hours, noise and light in GB zone

The Planning & Zoning Commission recommended approval of an ordinance to amend Article 4 (Zoning Districts), section 4‑8 (General Business) to set hours of operation and to regulate noise, lighting and sound for restaurants in the GB zoning district.

Councilmember Towery told the commission the ordinance is intended to protect residents who back up to commercial parcels along the Highway 205 corridor and that the initial focus is on restaurants that do not serve alcohol. Towery described a 300‑foot measurement standard — from the residential property line to the commercial property line — and discussed possible decibel thresholds raised during drafting (figures mentioned at the hearing included 85 dB and 75 dB as upper examples). To assist enforcement without necessarily requiring specialized devices, Towery said staff included a plainly audible standard in the ordinance language as a backstop for complaints and enforcement.

Peyton (planning staff) confirmed that the item had undergone prior public hearings before the P&Z board (Oct. 21) and city council (Oct. 27) and that the ordinance was submitted at the direction of Councilmember Towery. Commissioners asked clarifying questions about how the 300‑foot buffer is measured and enforcement methods; staff confirmed the measurement is from property line to property line.

A motion to recommend approval of the ordinance was made and seconded; the commission approved the recommendation by voice vote. The recommendation will be forwarded to City Council for final action.
