Committee approves amendment to 49 59 Genesee Street site plan after DOT drainage requirement forces larger bioretention

The Cheektowaga Principal Advisory Committee on Feb. 25, 2026 approved an amendment to a previously approved site plan for 49 59 Genesee Street after the applicant said New York State Department of Transportation review required changes to the drainage tie-in.
Project representative (Speaker 4) told the committee that NYSDOT took nearly nine months to provide review comments and that one DOT comment mandated that the outlet to DOT’s system be an 8-inch pipe. Because increasing the underground detention was estimated to be too costly, the applicant enlarged the on-site bioretention area and adjusted the sidewalk alignment. Speaker 4 said the filter area for water quality remains unchanged and that the enlarged bioretention adds roughly 980 square feet of surface storage while providing additional plantings.
Speaker 4 described the change as a modest increase — "adding, like, a foot and a half of deep surface area, that additional 980 square feet" — and said the overall green-space total would decrease slightly from 0.51 acres to about 0.5 acres (roughly 32% of the site), still above the 15% requirement.
Speaker 1 recommended amending the prior SEQRA determination to include the new information; Speaker 2 seconded the motion to amend the original resolution to reflect the revised design. The committee voted by voice and approved the amendment.
The committee noted no change to the building size or parking; the amendment was procedural to document the revised drainage and bioretention approach required by NYSDOT review.
