The Board of Commissioners on Jan. 22 voted to approve Petition 1370-25, a request to rezone a 6.00-acre parcel on Antioch Road from A-R (Agricultural-Residential) to R-80 (Single-Family Residential).
Planning and Zoning Director Debbie Bell told the board the property meets the legal lot-of-record and the county's Future Land Use Map designates the area as rural residential 3 with a 3-acre minimum; staff recommended conditional approval. The Planning Commission also recommended conditional approval with two conditions: the applicant must either obtain a variance to the minimum floor area requirement in R-80 or modify the house within 180 calendar days, and must obtain a variance to the side-yard setback requirement in R-80 or make appropriate modifications within 180 calendar days.
Petitioner Jerome Allen said the land is family property and will be used for residential purposes. Vice Chairman Edward Gibbons and County Attorney Dennis A. Davenport participated in clarifying that if variances are not obtained the structure must be modified to meet setback and floor-area requirements. Commissioner Eric K. Maxwell raised concern that the R-80 district has a three-acre minimum and that the petition’s lot size could present future limitations; Mr. Allen acknowledged the concern.
Commissioner Charles W. Oddo moved to approve the rezoning with the stated conditions; Commissioner Maxwell seconded. The motion passed 4-0 with Chairman Hearn absent.
