The Buffalo County Board of Commissioners adopted Resolution 2025‑03 on Jan. 28, authorizing the chairperson to sign a Development Restriction Agreement related to a Letter of Map Revision on the basis of fill (LOMR‑F) for a property described in Section 3, Township 9 North, Range 16 West.
The resolution states that the LOMR‑F request and accompanying engineer certifications meet applicable local standards required by the Federal Emergency Management Agency for the applicant seeking LOMR‑F, and that the county attorney’s office had reviewed the proposed agreement. The board authorized Chairperson Sherry Morrow to execute the agreement and directed that a copy of the resolution be filed with the Development Restriction Agreement.
The item was introduced during the zoning portion of the agenda by staff including Deputy County Attorney Andrew Hoffmeister and Zoning Administrator Dennise Daniels, and a licensed land surveyor, Mitch Humphrey, spoke about the Building Restriction Agreement. The board approved the resolution by roll call vote with all members voting in favor.
The action establishes the county’s recorded determination that the certified structures and fill meet local standards for the LOMR‑F application and creates a recorded development restriction tied to the property. The Clerk’s office will retain the resolution with the agreement as a public record.
