Developer appeals Planning Commission rejection of Red Brick Solar conditional use permit
Summary
Red Brick Solar, LLC appealed the Planning Commission’s tied vote against its Conditional Use Permit; the board was asked to review the appeal and the county planner’s rebuttal ahead of a May response. Under state law the developer has 10 days to file an appeal and the board has 60 days to respond.
Administrator Tracy M. Gee informed the board that Gentry Locke Attorneys filed an appeal on behalf of Red Brick Solar, LLC challenging the Planning Commission’s action (a tie vote) on the company’s Conditional Use Permit and the related §15.2-2232 hearing to determine consistency with the Comprehensive Plan.
County Planner Glenn Millican submitted a rebuttal to the appeal. Gee asked the board to review both the appeal and the rebuttal in preparation for the May meeting, when the board must take action or respond. Under Virginia law the developer may appeal the Planning Commission decision within 10 days and the Board has 60 days to respond to the appeal.
County Attorney Frank Rennie asked members to examine the materials and be prepared to consider the legal record and the planner's analysis at the May meeting.
