Spencer County approves three zoning changes, continues Top Flight R-2 request until July 19

The Spencer County Fiscal Court on July 7 approved multiple zoning applications and delayed consideration of one high-profile Top Flight Landing request.
Administrator Julie Sweazy presented four matters for reading. The court voted unanimously to approve:
- Ken and Paula Sherman: AG-1 to R-1 on a 4.961-acre tract in the 200 block of Inghram Lane, on the planning commission’s recommendation.
- Jacob and Tara Brown: R-1 to AG-1 on a roughly 15-acre tract on Elk Chase Drive (Lot 107C, Elk Chase Subdivision).
- Top Flight Development: AG-1 to R-1 on 12.7 acres on the 2700 block of Hochstrasser Road. The approval included binding elements requiring a 40-foot rear setback on all lots, homes of at least 1,800 sq. ft. built of brick, stone or hardy board, and a commitment to complete agreed shoulder work and tree removal on Hochstrasser Road within 120 days subject to county road department and Qk4 engineer inspections.
The court continued a separate petition by Nicole Ruth Development, LLC requesting a zone change from R-1 to R-2 for a 21-acre tract on Wills Way in Top Flight Landing to the Fiscal Court meeting scheduled for July 19.
Several residents at public comment raised concerns about pack-age treatment plant capacity and compliance; county staff and the engineer noted that the specific Top Flight rezoning continued to July 19 was not the same parcel that would flow to the pump station cited in public complaints. The continuance gives the court additional time to consider technical materials and resident concerns before a second reading and potential final action.
