Nelson County supervisors meet in closed session on Wagner zoning appeal and DSS bid results, reconvene and certify compliance

At a special called meeting on July 14, the Nelson County Board of Supervisors convened in closed session under Virginia Code §2.2-3711(A)(7) and (A)(8) to consult with legal counsel and receive briefings on two matters: the Wagner zoning appeal and the Social Services (DSS) building bid results. The motion to enter closed session was made by Jesse N. Rutherford and seconded by Dr. Jessica L. Ligon; the motion passed by roll call vote 4–0.

After conducting the closed session, the board reconvened in open session, and Mr. Rutherford moved and Dr. Ligon seconded a motion that the board certify that nothing was discussed in the closed session except the matters identified in the motion and permitted by the cited provisions of the Virginia Freedom of Information Act. The motion to certify was approved unanimously by roll call vote (4–0).

The closed session motion as read aloud by the board cited the legal bases and the specific topics: (A)(7) consultation with counsel regarding actual litigation where open discussion would adversely affect negotiating posture — identified as the Wagner zoning appeal — and (A)(8) consultation with legal counsel regarding specific legal matters requiring counsel’s advice — identified as DSS Building Bid Results. The minutes record no public deliberation of the substance of those matters; the board complied with statutory procedures by identifying the exemptions and later certifying the closed session.

Ernie Q. Reed, Central District Supervisor and Chair, presided. With Thomas D. Harvey (North District Supervisor) absent, the four present supervisors voted by roll call in favor of the motions to enter and to certify the closed session. No further public business was transacted at the meeting, and the board adjourned at 5:20 p.m.
