Summary
The board denied a requested road-radius variance for the Painted Hills subdivision but approved the Ivie Plantation recreational-vehicle-park conditional-use permit with amended conditions and a revised compliance date; commissioners questioned maintenance, safety and DEQ permitting needs during debate.
Lincoln County commissioners voted Feb. 8 to deny File 102 VA 23, a requested road-radius variance for the Painted Hills subdivision, after hearing engineering testimony and concerns from county officials about emergency access and driver compliance.
Planning Director Robert Davis and county staff recommended denial of the variance under Lincoln County Land Use Regulations. Engineer Ryan Wells of Jorgensen and Associates and developer Kevin Kilroy argued the proposed 100-foot-radius design better fits the terrain and could be safer if a 20 mph speed limit is observed. Chair Hansen and Commissioner Connelly questioned whether drivers and large vehicles would adhere to a low speed limit and raised concerns about HOA maintenance and emergency vehicle access. The motion to deny was made by Commissioner Bowers and was adopted; Chairman Hansen said he personally voted no on the denial motion.
On the same agenda the board approved File 102 CUP 22, Ivie Plantation Recreational Vehicle Park, adopting Findings of Approval and Conditions 1–7 with amended language in Condition 2 (clarifying total square footage allowed in one location) and changing a compliance date in Condition 7 to June 1, 2023. Engineer David Kennington (via video) described septic and water-system permitting and said a second well remains required for DEQ permitting of the proposed restaurant and eventual RV park. Applicant Donna Ivie said initial year-round operation decisions were aimed at helping displaced residents and that some outstanding DEQ items remained to be completed.
Commissioners also approved File 101 AP 23 (Bitter Creek Ranches Fifth Filing) and signed quitclaim deeds to finalize property vacations and related filings. County staff and the deputy county attorney advised the board on quitclaim process options and recommended proceeding with deeds in several parcels to clear title questions.
Next steps: planning staff will track outstanding DEQ clearances and the board’s administrative office will record the amended conditions and dates in the Ivie Plantation CUP file. No appeals or further hearings were announced at the meeting.
Votes at the meeting were taken by motion and adoption; specific roll-call tallies were not recorded in the meeting minutes included in the transcript except where noted.
