Planning commission moves to remove contradictory code language; churches to be conditional uses in RA-1-43

The Midway City Planning Commission on Feb. 10 voted to recommend a code text amendment to remove contradictory language that currently lists churches as a permitted use in the RA-1-43 zone. Staff told commissioners that Section 16.12.020(G) and Section 16.12.030 are inconsistent: one lists churches as permitted and the other as conditional. The amendment would delete the permitted-use listing so churches are treated as conditional uses in RA-1-43, consistent with other residential zones in Midway.
Staff's analysis said the change improves consistency and provides the public process that conditional-use review offers, requiring Planning Commission and City Council consideration for churches in residential zones. No public comments were received on the proposal. Commissioner Kim Facer moved to amend the code as drafted; Commissioner Suellen Winegar seconded. "I'll make a motion to amend Section 16.12.020 G that will remove the internally contradictory language in the section which presently lists churches as both a permitted use and a conditional use," Facer said. The motion passed with Commissioners Lineback, Nokes, Facer, Winegar and Farrell recorded as voting aye.
The commission forwarded the recommended amendment to City Council for final action. Staff will prepare ordinance language for Council consideration and transmit the commission's findings and recommendation.
