Sioux County finds Nextera wind-farm conditional use lawfully commenced

The Sioux County Board of Commissioners unanimously voted Feb. 2 to find that Nextera Energy’s conditional use permit for commercial wind-energy production lawfully commenced on the date the permit was approved, May 23, 2024, and continues through the present.
The decision followed a verbal update from Nextera Project Manager Austin Paxson and counsel David Levy of Baird Holm LLP, who told the board the company has pursued regulatory permitting, surveying and secured a generation interconnection agreement with Black Hills Energy. The board recorded that Nextera will submit a written progress report on the project and thereafter every six months.
Deputy County Attorney Skavdahl reviewed Sioux County’s Planning and Zoning Regulations regarding conditional use permits before the motion. Commissioner J.W. Geiser moved the finding; Commissioner Hal Downer seconded. The roll-call vote was Downer, yes; Geiser, yes; Skavdahl, yes.
The board’s action is a formal finding about the status of the conditional use permit and does not, by itself, alter other permitting or regulatory requirements that may apply at state or federal levels. Nextera’s written reports to the county will provide further documentary updates on permits, construction milestones and any outstanding approvals.
The board took no additional action beyond the finding at the meeting; future compliance steps and the company’s biannual written updates were recorded as the next procedural items.
