County leaders flag state zoning changes as potential preemption to local code

County participants raised concerns that a proposed state-level affordable housing measure could preempt local zoning rules, prompting discussion about whether Warren County should move to update its subdivision and zoning ordinances sooner rather than later.

"Basically, what state is doing is deregulating lot sizes, septic and well," Committee member (speaker 4) said, warning that legislative changes could limit the county's authority to require larger lots or certain septic standards. The speaker said county associations are closely watching the bill and that the measure could require the county to adjust or abandon parts of a planned local code rewrite.

Speakers noted longstanding complaints from builders about the county—xisting subdivision ordinance and agreed the code is likely outdated in places. Participants discussed options: incremental fixes to specific provisions or a full rewrite of the zoning code, subject to staff capacity and possible state action that could preempt local changes.

No formal motion was made; participants agreed to monitor the state bill and to have staff and commissioners identify the major local decisions that would be affected if the state legislation is enacted or amended. The group also discussed coordinating with the APC and zoning staff to determine which recommendations from the 2022 plan should be pursued locally and which may be affected by state law.
