Planning board approves shared-dock setback variances for properties on NE 7th Drive

The Planning and Zoning Board of the City of Boca Raton voted to grant variances allowing a shared dock with 0-foot side setbacks in lieu of the typical 10-foot requirement for two adjacent properties at 3798 and 3800 Northeast 7th Drive.
Courtney Wood, a zoning officer with the city, explained that both properties sit at a canal dead end and have ‘‘inherited dock and bulkhead issues’’; staff recommended approval for both variance requests with a condition that the property owners execute a shared maintenance agreement. Wood said the dock in some form has existed since at least 2005 and that the Marine Advisory Board recommended approval on Dec. 2, citing the site’s physical constraints.
Dori, the petitioner’s representative for JuleTech (owner of 3798), described efforts to close out abandoned permits and said the permit history showed a seawall restoration permit but no dock drawings. She told the board she had spoken with both owners and that both parties agreed to maintain the joined dock and sign the required agreements; she added that the owner of 3798 is selling the property and needs the permit matters resolved for the sale.
After a public hearing with no outside speakers, the board took separate motions to approve the requested variances for 3798 and 3800; both motions passed by recorded unanimous votes. The staff-recommended condition requiring a shared maintenance agreement remains part of the approval.
