Montclair council continues first reading of oversized-vehicle ordinance to Dec. 1, adopts consent calendar

The Montclair City Council opened a public hearing on the first reading of ordinance 25-1013, which would amend Chapter 8.02 to regulate the parking of oversized residential vehicles on public streets. With two council members absent, Council Member Lopez said he preferred to wait for a full body and moved to continue the ordinance’s first reading to the Dec. 1 meeting.

"I would personally be comfortable moving the item to our next meeting on December 1," Council Member Lopez said, citing prior workshop discussion and his preference to have the full council present for the matter.

The mayor called for a second and an electronic vote; the council chair stated the motion was adopted. The council then considered the consent calendar, noting a correction to the warrant register item B8 previously signed by Council Member Martinez in absentia; the consent calendar was moved and approved by electronic vote on the record.

The city clerk noted that the Brown Act limits council discussion of items not listed on the agenda during public comment. The city attorney also announced that three closed-session items listed on the agenda were being withdrawn and that the council would still meet in closed session on pending litigation (Ibanez v. The council recessed to closed session at the end of the meeting; no final action on ordinance 25-1013 was taken beyond the continuance to Dec. 1.
