Minocqua plan commission recommends approval of Lakeside Landing condo addendum pending litigation confirmation

The Minocqua Plan Commission on Feb. 24 recommended that the Town Board approve the Preliminary Second Addendum to the Lakeside Landing Condominium Plat (Condominium Plat #05-26), but required the condominium association provide documentation confirming the related litigation over parking is complete before the addendum is recorded with Oneida County.
Scott Ridderbusch, Oneida County planning staff, told the commission the addendum “is just identifying and changing parking space designations and identifying common areas for berthing space access.” He added the first addendum was recorded in May 2023 and that litigation between unit owners and the condo association had occurred after that filing.
Member Billy Fried said he did not think the litigation was complete. Ridderbusch replied he did not have any direct knowledge of whether litigation had concluded and said the plat request came from both unit owners and the association. Member Mark Pertile urged ensuring the litigation is complete before the plat is recorded.
Pertile moved, and Jay Christgau seconded, to recommend approval of CONDOMINIUM PLAT #05-26 as presented, subject to documentation from the condominium association supporting the 2nd Addendum prior to recordation with Oneida County. The motion carried by voice vote, 7-0.
The addendum, submitted by Wilderness Surveying (surveyor Jimmy Rein), designates Limited Common Elements (LCEs) for parking spaces and berthing spaces and clarifies which unit owners and the bar have rights to specific spaces; Ridderbusch said the changes do not alter the number of parking or berthing spaces, only who has rights to them. The commission’s recommendation sends the proposal to the Town Board with the stated condition; the plan commission did not record the plat itself.
Next steps: the commission’s recommendation will be forwarded to the Town Board for action, and the plat will not be recorded with Oneida County until the condominium association provides the requested documentation confirming the litigation issue is resolved.
