The Satellite Beach Planning Advisory Board on Dec. 1 recommended approval of a conditional use permit to allow an indoor immersive art gallery at 1296 Highway A1A, after staff said the proposal is allowable in the commercial zoning district but raised concerns about 24/7 hours and exterior illumination.
Staff told the board that the application seeks to amend city code section 30-416(c)(8) to list an indoor immersive art gallery as a conditional use under the category of cultural institutions. "The hours of operation that the applicant is requesting is 24 hours a day, 7 days a week," city staff said and warned that private rentals and special events could increase parking demand, traffic and noise beyond normal business hours.
Applicant Jonathan described the project as a projection-based, creative gallery and said he envisioned quiet, late-night access rather than parties. "The 24-hour thing was more or less I wanted it to be a place where people could at least enjoy the beach 24/7," Jonathan said, adding that he could turn off exterior illumination and paint the building black if necessary.
Board members pressed for limits. One member said the city ordinance restricts business hours and staff confirmed that, noting the relevant city hours and that the building "has to be dark" to comply with lighting regulations and avoid interfering with sea turtle lighting. Another member worried that unrestricted late-night access could attract louder, disruptive activity at 2 a.m.
Staff also reported that the site’s marked parking spaces were verified and "adequate to support the proposed gallery use and associated events based on the site's approved parking configuration," but cautioned that frequent special events could change parking and traffic needs.
After discussion, a motion to recommend approval of PAB 25-06 (the conditional use permit and related code amendment) was moved and seconded. During roll call, the board recorded a No vote from Alan Lamotte and Aye votes from Kevin Finnegan, Steven Terry, Ben Glover and David Deliden; the motion carried.
The board recorded the recommendation; no additional procedural steps or Council scheduling were discussed during the meeting.
