The applicant offered several conditions, including a Type B buffer along Foster Forge Road, prohibitions on manufactured homes and duplexes, a covenant requiring curbside trash service before the first phase records, and architectural elevations to guide future construction.
Applicant Chaney Cole introduced the project and said the homes would be ‘‘not track homes’’ and estimated a sales range of roughly $475,000–$500,000. "I'm Chaney Cole, and I'm here on behalf of the Kirkpatrick Way project," Cole said during his presentation.
Opponents and several commissioners raised technical and policy concerns. Resident John Snowden told the board rezoning is ‘‘where you open Pandora’s box,’’ urged caution about MXR zoning and warned that higher‑density applications previously proposed for the parcel (townhomes/apartments) would have broader fiscal and character impacts. Commissioners questioned whether existing water‑line capacity and fire‑flow could meet required standards; staff said fire‑flow and drainage will be reviewed at preliminary plat and that the Planning Board recommended approval with the proposed conditions.
Commissioner Jarvis moved to approve the rezoning with the applicant’s conditions; the motion included eight specific conditions (conform to conceptual plan, minimum 20,000‑sq‑ft lots, required streetscape and buffers, prohibitions on manufactured homes and duplexes, curbside trash covenant, architectural consistency, and a maximum of 20 lots developed as single‑family dwellings as the principal use). Chair Zimmerman seconded. The motion carried 4‑3.
The board’s action permits the conditional MXR zoning with the recorded conditions; staff noted any future change to the zoning or conditions would require a new application and board action. The public‑hearing record, planning‑board recommendation and the conditions adopted by the board will govern preliminary plat review and subsequent permitting.
