Following a responsibility public hearing on April 6, the Bay City City Commission voted to deem ProTech Cabling Systems a responsible contractor under Ordinance 2021-14.
Rob Simons, project manager and partner at ProTech, told the commission the company's elevated EMR (experience modification rate) reflects several repetitive-strain or minor recordable incidents rather than severe on-the-job injuries. "These have been strains and pulls. We've never had a work incident where somebody has got hurt negligence like negligence of a safety violating a safety program," Simons said, describing the company's safety program and long-tenured staff.
Commissioners who reviewed the contractor report agreed the incidents were largely repetitive-stress or non-emergency events and praised ProTech for following up on employee care. "Those are 7 employees that got medical treatment and follow through; I don't think small businesses should be dinged for taking responsibility for their employees," Commissioner Doyle said.
After discussion, the commission approved the recommendation to deem ProTech responsible; the motion passed on a 9–yes roll call. Commissioners said the designation allows the city to move forward with procurement and contracting activities where ProTech is tentatively in consideration.
The council record shows the hearing and related item will be implemented per ordinance procedures; staff will follow procurement rules for contracts.
