Agency official (S5) updated the commission on the R. Wharton development agreement. Staff said Horton’s outside counsel forwarded requested changes after district counsel review; those changes appear aimed at allowing larger takedown closings later in the project (reducing the total closings from eight to six) but would not reduce the county’s earnest‑money protections until the agreed milestone (after the fifth closing). Staff said the requested tweaks do not affect the initial two closings, which contain the critical early sales and the earnest‑money protections.
