Shiawassee County board approves settlement in two pending lawsuits after closed session

The Shiawassee County Board of Commissioners voted 6–1 on Feb. 11, 2026, to approve a resolution authorizing settlement of two pending lawsuits and to empower County Administrator Dr. Brian Boggs and the county attorney to sign a Consent Judgment and any documents necessary to submit the judgment to Shiawassee Circuit Court.
The board first voted to meet in closed session under Section 8(e) of the Open Meetings Act to consult with the county’s attorney about settlement strategy in Shiawassee County v. Elite Excavating, LLC (Case No. 24-9233-CZ) and Country Barn Estates, LLC v. Shiawassee County (Case No. 25-9839-AA). The meeting entered closed session at 5:04 p.m. and reconvened at 5:40 p.m.
After reconvening, Commissioner Cindy Garber moved and Commissioner Bill Johnson seconded a motion to approve the resolution effecting the settlements and to authorize Dr. Boggs and the county attorney to sign the Consent Judgment and any related pleadings. The motion carried on a roll-call vote: Commissioners Howard, Shepard, Holzhausen, Johnson, Garber and Chairman Gregory Brodeur voted yes; Commissioner Josh Haley voted no.
The board’s action directs county officials to finalize and file the Consent Judgment with the circuit court. The resolution’s text, as presented to the board, instructs Dr. Boggs and the county’s legal counsel to sign and submit any additional documents necessary to effectuate the resolution.
