Planning commission approves text amendment narrowing snow-plow agreement requirement

At a public hearing on Public Hearing No. 26-002, staff member Daniel presented a proposed text amendment to village code sections addressing the village's snow-plow agreement. Daniel said the amendment would clarify that a snow-plow agreement is required only when public roads are involved, allow the village attorney to review agreements and the village administrator to sign them, and remove the full, word-for-word snow-plow agreement from the code so the agreement can be tailored to specific developments.

Daniel told commissioners the change is intended to simplify the process and allow greater flexibility without requiring a code amendment each time the agreement needs modification: "The first part of the amendment would be to add language that clarifies that a snowplow agreement is only needed if there are public roads." He also summarized the second change: "The second part of the amendment removes the exact snow plow agreement out of our village code. Currently, our village code has the entire agreement word for word in the code." Staff recommended approval of the amendment as presented in Exhibit A.

Commissioners asked how emergency access and enforcement would work before roads are accepted and whether letters of credit and third-party plowing remedies would be available. Daniel said the village's letter-of-credit process and the agreement's enforcement provisions provide mechanisms to address developer noncompliance, including contracting a third party and billing the developer for costs. After discussion, the commission closed the public hearing and voted to approve the amendment; the transcript records the motion carried.
