Summary
The Planning Commission unanimously recommended that the town council adopt ordinance 2026-09, which clarifies the definition of ordinary maintenance/repair and adds provisions governing involuntary removal of noncomplying buildings or structures that decline over time.
On May 15 the Springdale Planning Commission voted unanimously to recommend adoption of ordinance 2026-09, which revises Chapter 10-21-8 of the town code to clarify the definition of ordinary maintenance and repair and to add a new section addressing involuntary removal of noncomplying buildings.
Staff said the ordinance grew from a town-council interpretation request and subsequent commission work to define ordinary maintenance vs. improvements that exceed ordinary repair. The proposed language clarifies when a structure that has degraded over time may be rebuilt or must meet other standards, and it outlines conditions under which rebuilding noncompliant features may be allowed.
Commissioners said they had spent several meetings refining the text and expressed confidence the draft resolves ambiguities and accounts for catastrophic and non-catastrophic decline of buildings. The commission then moved to recommend the ordinance to the council with unanimous support.
Next steps: The recommendation will be transmitted to the Town Council for consideration.
