Assistant Director of Community Development Vince Velasco told the commission the project had received a one‑year time extension in August 2025 but the developer could not complete certain milestone conditions (specifically conditions No. 7 and No. 9) tied to cleanup and regulatory clearance. Velasco said the developer provided documentation of correspondence with the Department of Toxic Substances Control and a schedule anticipating DTSC clearance in December 2026; the requested extension to Feb. 18, 2027 provides a buffer in case that schedule slips.
A representative of the applicant thanked staff for coordination and described site maintenance and security improvements, saying staff members are in regular contact with the applicant. The applicant noted an incoming tenant offer and reaffirmed maintenance actions including painted walls, secured fencing and 24‑hour security cameras.
After no further questions from commissioners, a motion to approve the time extension and adopt Resolution 316-2026 passed by roll call. The commission noted the 14‑day appeal period for the action.
Staff said the extension is intended to allow the applicant to obtain DTSC clearance, proceed with construction permits and then begin vertical construction once conditions are met.
