The City Council approved a settlement on Oct. 29 arising from a June 2022 notice by the San Diego County Air Pollution Control District (APCD) that alleged emissions from bullet impacts at the police pistol range on Federal Boulevard caused a nuisance. Fritz Ortlieb, deputy city attorney, told the council the facts were considered in closed session and remain disputed by the city; the settlement does not admit or deny liability.
Ortlieb summarized the allegations and settlement terms: $700,000 total with $200,000 payable to the APCD and $500,000 directed to a supplemental environmental project consisting of a micro-mobility project in the Mount Hope area. He said the notice alleged emissions occurred roughly from May 2020 to May 2021 and that the APCD had asserted the city had operated without a permit.
Public commenters criticized the lack of transparency for closed-session settlements and asked for detailed information about how settlement funds would be spent. Councilmember Von Wilpert moved approval of the staff recommendation and the council approved the funding to implement the settlement.
