Resident urges changes to driveway rules; council asks staff to document UDO issues

A Tipton resident identified in the meeting record as Mr. Webb urged the council to review how the new Unified Development Ordinance is applied to driveway cuts, building heights and variance processing.

Mr. Webb described plans for a 40-foot-wide by 30-foot-long garage with two 16-foot doors and said the city’s maximum driveway cut width of 25 feet would not allow access to both doors. He said he had paid $400 for a variance that he later learned may not have been necessary after staff clarified the method for measuring building height (using roof mid-height rather than the ridge line), describing an expectation of a partial refund.

Council members and planning-affiliated speakers said they did not want the city to change rules for single cases and recommended the building commissioner and planning staff document recurring permit and variance issues. The presiding official said he and staff would meet the following morning to review past permits and follow up with Mr. Webb and others. One council member suggested any ordinance changes be initiated by the planning commission rather than altered ad hoc by the council.

The council did not take immediate action to change the UDO at the meeting; members instructed staff to gather documentation and return with recommendations if patterns emerge.
