Board grants Petersen rear-yard variance; staff notes separate corner-sidewalk issue

The Dickinson County Board of Adjustment on Sept. 23 approved a rear-yard variance for Gary and Jo Lene Petersen that will allow construction of a replacement home with a basement at 15515 250th Ave in Spirit Lake.
Gary Petersen told the board he and his wife bought the property about 10 years ago and plan to retire there. Petersen said he placed white flags for measurement and noted family and storm-shelter needs as reasons for a basement and improved accessibility. He said he was selling his other home to another couple for $1.00 and having the replacement home meet accessibility needs was important to the family.
Planning & Zoning Administrator Megan Kardell told the board staff discovered an additional variance issue tied to a corner walkway that was not part of the submitted request; she said the Petersens will need to return next month for that separate corner variance. County Attorney Steven Goodlow advised the board to vote only on the rear-yard variance before them.
A letter from Shirley Einerwold was read into the record. Susan Clark moved to approve the variance, Alex Oponski seconded, and the vote was recorded in favor by Ashland, Clark, Oponski and Berhow, 4-0.
The board approved the rear-yard variance so the applicants may proceed with the portion of work covered at the hearing; the corner-sidewalk issue must be addressed in a subsequent application and hearing.
