Zoning hearing officer denies setback-variance request in DuPage County
Summary
Zoning Hearing Officer Robert Tarthall recommended denial of case Z26 06, a request to reduce a required 10-foot setback to about 8 feet for a concrete slab, saying the petitioner’s testimony and the record did not meet the requirements for a variation; he approved March 18 minutes and adjourned.

Zoning Hearing Officer Robert Tarthall called the DuPage County zoning hearing to order and announced a recommendation to deny a setback-variance request in case Z26 06.
At the April 1 meeting, Tarthall said he had reviewed and adopted the transcribed minutes of the March 18 public hearing and the written minutes of the March 18 recommendation meeting. "I've reviewed the minutes and I'm hereby approving the minutes," he said, noting there was no public comment submitted before or during the meeting.
The case Tarthall announced, referenced in the transcript as Z26 06, sought a variation to reduce the required 10-foot setback for a new concrete slab intended for a shed to approximately 8 feet. "That's a request for variation to reduce the required setback for a new concrete slab for a shed from the required 10 ft to approximately 8 ft," he said.
After reviewing the record, Tarthall recommended denying the variance. He cited the petitioner’s testimony that the slab was larger than the proposed shed and that it was intended "simply for a convenience for storage on the apron of the shed." He added that, "in part because of that, but in part because of the balance of the testimony, I don't believe that the requirements for variation were met."
Tarthall said he had signed the written recommendation and would transmit it to the county development committee for further processing. He then stated there was no old or new business, noted there were no objections present, and adjourned the meeting.
Next steps: the written recommendation denying the variance will be transmitted to the county development committee; the transcript did not record any formal vote tally or motions made by other participants.
