Sheriff Josh Wayne flags deed language, reversion clause in Robinson property draft

Sheriff Josh Wayne told the Madison County Commissioners on April 21 that a draft deed for the Robinson property contains wording tied to legislation and a reversion clause that could return the property to the state if it is no longer used for the Sheriff's purpose.

Wayne said the developer's draft refers to the 'Sheriff's Department' rather than the 'Sheriff's Office,' a phrasing he and county counsel found inconsistent but unlikely to be changed because, as he put it, 'it's tied to the legislation.' Wayne said he and Prosecutor Dick Gaskins reviewed the draft and identified discrepancies DRC would not fix.

'It should say deeded to us,' Wayne said, arguing the property needs to be deeded to the county if the county is to hold ownership responsibilities. He added that the draft includes a reversion clause that would revert the parcel to the state 'without payment' if it ceases to be used for the Sheriff's purpose.

County Administrator Rob Slain and others discussed whether deed language could be altered to specify the County Commissioners as the grantee instead of the Sheriff's Office, but participants noted that statutory language in the enabling legislation appears to control the wording. Wayne said the county could accept the property and pay associated costs if necessary, but that DRC was not receptive to suggested edits to the draft.

Wayne also noted higher fuel costs are affecting departmental budgets and said the county should know more about those impacts soon. The meeting record shows no formal decision on the Robinson parcel during this session; commissioners and staff reviewed the draft and identified outstanding legal and ownership questions to resolve before any final action.
