Area Plan Commission backs allowing private active parks in industrial district

The St. Joseph County Area Plan Commission voted April 21 to send a favorable recommendation to the county council on APC 3083-26, a text amendment that would allow private active parks as a permitted use in the I (industrial) zoning district.
Ariel Sharief of APC staff told the commission the amendment would change Title 15, chapter 154, section 154.211 to treat private active parks — places with active recreational uses such as game courts, soccer fields and splash pads — as permitted in industrial areas. Staff cited a recent approval for indoor recreational courts and said the use is “functionally similar to other uses permitted already in industrial, including stadiums, auditoriums, and arenas, and community centers.”
Commissioners raised practical questions about operation and oversight. Members asked whether private operators could charge fees, whether combat sports or boxing could be held, and who would be responsible for security or liability if incidents occurred. Staff answered that private operators could charge fees, that alcohol service would require a liquor license and be treated like other controlled uses, and that liability for illegal acts or inadequate security would rest with the property owner rather than the county. “I cannot envision how that would subject the county itself to any sort of liability,” staff said.
During the vote, Dr. L moved to send the amendment with a favorable recommendation; Miss Hannon seconded. The roll call recorded eight votes in favor and one against (Mr. Deer), and the chair announced the motion carried.
The commission’s recommendation goes to the St. Joseph County Council for final consideration; the council will hold its own public hearings and may amend or reject the ordinance.
