Dodge County panel approves variance allowing Prescher parcel split with conditions

The Dodge County Board of Adjustment on Oct. 16 approved a variance allowing Darryl J. Prescher to divide a parcel into two lots with 90-foot widths, below the county's 125-foot minimum for lots not served by public sewer.

The board approved the variance by a 4-1 vote after hearing from Darryl Prescher and two supporters, Cody and Holly Prescher. Rodney Justman moved to approve the request with conditions; Russell Kottke seconded.

Under the approved condition, trees along the driveway must be cleared and maintained to town road standards (66 feet), and the driveway must be improved to a minimum width of 22 feet. The Board directed staff to issue a land use permit incorporating those conditions if they are met.

The variance sought relief from Subsection 7.3.2 of the Dodge County Land Use Code, which requires a 125-foot lot width at the building setback line for lots not served by public sewer. The request proposed two lots each 90 feet in width; the staff notice included that the proposed lot widths are prohibited by the Code without a variance.

The meeting record shows a 4-1 tally in favor; the transcript does not identify which member cast the opposing vote. The Board earlier approved minutes from its Oct. 9 meeting by a 5-0 vote and confirmed compliance with open meeting and public hearing notice requirements. Andy O'Brion of the Land Resources and Parks Department attended at the chairman's request and confirmed statutory notice procedures.

The board adjourned after noting other business, including a petition listed for November for Lomira. Any person aggrieved by the Board's decision may file a verified petition in circuit court within 30 days after the decision is filed, as explained during the hearing.
