Valley County commissioners on March 2 tabled action on a development agreement tied to an approved conditional use permit for a proposed Brown Construction Yard staging site, citing outstanding traffic and road‑impact questions.
Staff introduced the development agreement draft and explained it implements conditions attached to a previously approved conditional use permit. County consultants and parametrics engineers flagged key questions related to proximity to State Highway 55, sight distances at the Lumis‑Highway 55 intersection, and whether the board should require a road development agreement rather than a simpler road mitigation arrangement. Parametrics noted applicant trip counts around the threshold that triggers more extensive traffic review and recommended a proportional‑share approach to intersection improvements.
Kendra Brown, the property owner, told the board that dedicating a 35‑foot right‑of‑way from the centerline would require giving up substantial acreage from her parcel and asked that compensation or negotiation be considered; she also raised aesthetic concerns for the scenic byway and asked that landscaping protections be required. County staff and parametrics said the developer is expected to pay for relocating existing walking paths if required and that temporary construction entrances would be rock‑surfaced during construction and paved permanently only after the construction phase.
Commissioners asked staff to obtain final letters from parametrics and the road department and to review McGregor townsite conditions that could affect the intersection. The board moved and seconded a motion to table the item to March 9 at 3:30 p.m. so staff could provide an updated engineering letter and additional coordination with outside agencies (including ITD) and developers.
Parametrics and road staff will provide a prioritized review and a draft framework for a development agreement or road development agreement to be considered at the continued hearing.
