"Carpentersville agrees to identify and hold harmless the county for any ownership issues that arise from the IGA," the county attorney summarized, adding that the county engineer will retain authority to issue conditional permits and only the county may authorize an opening if preconditions are not met.
Brad Stewart, village manager for Carpentersville, told the board the village is "cautiously optimistic" it will obtain the necessary signatures in the coming days and thanked county staff for moving the item forward.
Board members stressed the IGA includes protections—specifically conditional permits and hold‑harmless language—designed to prevent the project from opening before legal and platting requirements are met. The State’s Attorney’s Office said it structured the IGA so that the county can withhold opening privileges until all required signatures and plats are in place.
The board approved the resolution by voice vote and later by roll call when requested; staff said the building permit will not be issued until the written agreement with property owners is executed. The board directed staff to provide updated status to development committee members as the agreement proceeds.
