Council previews new Title 11 ‘adequate public facilities’ code; seeks fire district input on standards

Rathdrum — City staff presented a draft Title 11 code intended to establish an "adequate public facilities" standard for Rathdrum, formalizing how development proposals are tested against city master plans for water, sewer, streets, parks and emergency response.

The draft grew from a December workshop in which council, planning commissioners and staff divided into working groups to propose measurable standards for each facility type. Staff said the draft ties review triggers to development stages — annexation, zoning and subdivision — and would require applicants to demonstrate conformance or fund mitigation tied to city master‑plan standards.

Council and members of the public raised questions about measurable metrics and possible loopholes. One commenter suggested the draft’s language that only ‘‘facilities affected by the development’’ be evaluated could be construed by applicants to avoid reviewing some facilities; council asked staff to change that language so applicants must demonstrate the status of all relevant facilities, even to confirm no impact. Council also asked staff to request response‑time data and mitigation recommendations from Northern Lakes Fire; staff cautioned that some emergency service metrics (like staffing) are controlled by separate districts and cannot be unilaterally imposed by the city but that the city could require impact mitigation such as land reservation or contribution for future facilities where a direct nexus exists.

Next steps: Staff will schedule a half‑day workshop to work through Title 11 and related updates to Titles 12 and 15; council asked for revisions to the draft that close the loophole and add clearer, measurable standards or mitigation options to present at that workshop.
