The Commission on Ethics voted unanimously by roll call to approve a joint stipulation resolving two allegations against respondent John Stevens, a commissioner with the Cedar Hammock Fire District. Commission advocate Mr. Burns told the panel that Stevens would admit one allegation of misusing his position and pay a $1,000 fine; the other allegation would be dismissed because the evidence did not warrant further proceedings.
Attorney Robinson, representing Stevens, told the commission that Stevens would not appear in person for the proceeding. The commission heard no disclosures and no commissioners requested recusal. After brief confirmation there were no questions, Commissioner L. moved and Commissioner Rogers seconded the motion to adopt the stipulation. Miss Westberry called a roll that recorded six votes in favor and one absence; the motion passed.
Under the commission's rules, a rejected stipulation could have sent the complaint to the Division of Administrative Hearings for an evidentiary hearing; by approving the joint stipulation the commission accepted the admission and imposed the agreed fine. An order adopting the stipulation will be entered in due course.
