The Houston County Planning Commission voted to recommend that the County Board grant a conditional‑use permit allowing Ryan and Stephanie Schultz to build a single‑family, nonfarm dwelling on less than 40 acres in the Agricultural Protection District in Spring Grove Township.
Staff read notice of the application and explained the request would permit the applicants to section off about 5 acres from a 57‑acre family parcel. The applicants told the commission they plan to use an existing private driveway and that utility lines run along that drive; the nearest service would be about 125 yards from the proposed build site. County staff noted the access must meet a 12% grade requirement and that the applicants will work with county technicians to locate a compliant approach.
In presenting findings, planning staff said the request conforms to the county land‑use plan and that the applicants demonstrated a need for a rural dwelling. Staff recommended standard erosion‑control measures and noted the site had been preliminarily reviewed for septic suitability. County staff said Chance Nelson had found two Type I septic system locations that meet local requirements, and recommended the applicants verify soils and obtain necessary building permits before construction.
Commissioners discussed language in an older soil survey that appeared to overstate slope in parts of the township; staff said the cited source was an older mapping product and that field inspections and licensed septic contractor review indicated the proposed site can meet septic and road standards. No members of the public spoke in opposition during the hearing.
Chair moved to accept the findings and to recommend the conditional‑use permit with three conditions: compliance with all applicable federal, state and local laws; county access to the premises at reasonable times to verify compliance; and that the new parcel boundary be substantially similar to the boundary in the application. The motion carried on roll call. The commission’s recommendation will be forwarded to the Houston County Board for final action.
