Commission approves grading-code updates to clarify permits, erosion control and thresholds

Associate Planner Treston Rodriguez presented text amendments to Fernley’s development code to clarify grading definitions and thresholds. Rodriguez said the proposal adds three definitions (grubbing, standard grading and engineered grading), sets a 50‑cubic‑yard permit threshold and clarifies that engineered grading (over 5,000 cubic yards, cuts/fills over 15 feet, or slopes above 20 percent) requires licensed civil and geotechnical review.

City Engineer Maria Pasandez told commissioners work under 50 cubic yards remains exempt from a grading permit and summarized erosion, stormwater and dust control thresholds tied to one and five acre disturbance levels, and said inspection, permit expiration, bonding and stop‑work authority are clarified in the amendment.

Commissioners asked whether projects under one acre would see new requirements; staff answered the 50‑cubic‑yard trigger remains unchanged. The commission voted 7–0 to recommend approval; the amendment moves to the City Council for final action.
