The Yankton County planning panel voted unanimously to recommend a conditional-use permit for a permanent swimming pool and supporting facilities at Rikens RV Park, 3912 Buck Street.
Staff introduced the request under the Lakeside Commercial zoning provisions (citing article 11 §1105, article 18 §1805 and article 19 §1905) and described the property as Lot 11, Whitetail Run. Applicant Matt Evans told commissioners he bought the park about a year ago and has made site upgrades — he said he planted nearly 250 trees, widened gravel roads, and sodded sites — and is proposing a 30-foot-by-60-foot in-ground pool, a pump house to house pumps and heater equipment, and bathrooms/shower facilities adjacent to the pool. Evans said the pool area will have concrete around it, a full perimeter fence with a gated lock, and that the pool will be closed at dusk.
Commissioners and staff discussed how the pool is classified for setback purposes (staff noted a permanent in-ground pool is treated as a structure for setback calculations) and confirmed applicable yard requirements were considered. Staff also reminded the panel that any work that varies from the previously issued conditional-use plan must return to the conditional-use process and that, if the planning panel recommends approval, the application then proceeds to the county commission for final action and separate permitting steps.
No members of the public spoke during the comment period. After commissioners went through required findings — including notice of public hearing, ingress and egress, traffic and pedestrian safety, utilities and buffering, and limitations on signage (staff said signage should be limited to pool rules on the fence, not advertising) — a motion to approve the conditional-use permit was made and seconded. Roll-call votes were recorded as Huber: yes; Kettering: yes; Hmel: yes; Welsh: yes; Clark: yes. The planning panel’s approval is a recommendation to the county commission; the project remains subject to the county commission’s action and standard permitting.
The planning panel’s recommendation does not authorize construction. Next steps are county commission consideration and the required building and health permits.
