Planning commission opens discussion on solar, battery storage, design guidelines and enforcement; forms subcommittee work

During a work-session portion of the meeting, Elbert County planning commissioners discussed supplemental standards for solar and battery-storage projects, potential architectural and design guidelines, and enforcement mechanisms for code violations.

Staff presented model language from other jurisdictions and suggested starting with supplemental design standards for solar siting and screening rather than a full-scale 1041 overhaul. Commissioners agreed to form subcommittee(s) to refine design guidance and to examine Lincoln County and other model codes as starting points. Several commissioners urged a planning approach that directs large-scale solar and battery facilities toward appropriate areas of the county rather than allowing scattered, ad hoc siting near housing.

Commissioners also raised enforcement concerns for tree-preservation and other regulations, asking staff to consider mechanisms such as making replacement requirements a binding condition of approval and using stop-work orders or fines as potential remedies. Staff noted that enforcement policy (voluntary compliance versus active enforcement) is a BOCC-level policy decision and that legal counsel should be consulted on how to give the rules practical 'teeth.'

The commission asked staff to organize subcommittee meetings and return a proposed work plan and draft language for commission review.
