Commission approves sign setback variance for Tree Point mixed‑use site

The Hilliard Planning and Zoning Commission on March 12 voted 7–0 to approve a setback variance for an existing sign at the Tree Point mixed‑use development.

Staff told commissioners the sign, originally used by a prior tenant, sits 11 feet 1 inch from the public right‑of‑way, short of the 15‑foot setback required by code, and is located within a sanitary easement. Staff said aerial imagery shows the sign in place since at least 2013 and that the city’s engineering department would allow it to remain provided the property owner is solely responsible for any relocation or removal required for future utility work. "Staff recommends approval with the conditions listed, provided that the sign is no closer than 11 ft to the public right‑of‑way," the staff presenter said.

Commissioners asked whether the sign could be moved outside the easements; staff responded that a narrow strip between a waterline easement and the sanitary easement leaves no practical place nearby to relocate the sign. The presenter noted that, if future maintenance requires removing the sign, the property owner would bear all costs for relocation.

Following a brief question period, a commissioner moved to approve PZ‑26‑3 “as recommended by staff.” The motion was seconded and the roll‑call vote was unanimous: Chair Schneck, Mr. Italiano, Mr. Martin, Mr. Saunders, Mr. Moog, Mr. Marsh and Vice Chair Papsidero all voted yes and the motion carried 7–0.

The approval included the staff conditions: the sign must meet the city’s illumination requirements and a permit must be obtained; the property owner must pay for any removal or relocation necessitated by utility work.

Next steps: staff will proceed with standard permitting and enforcement of the stated conditions.
