Commission authorizes staff to respond to late RDA refund request from Radiant Generation

Commissioners discussed a late refund request from Radiant Generation for a tax-incentive/RDA payment. Staff said the participation agreement requires the project to request refunds by April 1; Radiant Generation contacted the county on April 20 seeking a refund. The commission noted the participation agreement provision and that the RDA board historically has discretion to deny refunds when deadlines are missed. Commissioners authorized staff to prepare and send a response and suggested involving legal counsel to review the contractual deadline and any equitable remedies.
