Neighbors oppose lot-configuration variance, commission approves; code-enforcement concerns left unresolved

Madison County’s Planning and Zoning Commission recommended approval of a variance allowing a 6.355-acre irregular lot at 2870 Crabapple Hollow Road to remain in its current configuration even though the lot does not meet the county’s length-to-width ratio. Multiple neighbors opposed the variance at the public hearing, citing ongoing truck traffic and noise, trash on and near property lines, large buildings used for business purposes, and concerns about septic systems and runoff affecting a downstream creek. Jessica Coleman told the commission she has observed foam in the creek downstream of the site and described repeated truck activity; Kyle Coleman and others described perceived commercial use of a large shop and local impacts on quiet use of nearby farmland.

The commission limited its deliberation to the narrow lot-shape standard required by the county code and approved the variance after a motion and second. Chair Kenola Scott and other members emphasized that operational complaints (trash, alleged unlawful business activity, runoff) are outside the scope of a length-to-width variance and directed neighbors to pursue complaints through code enforcement and, if necessary, civil remedies.

The commission’s recommendation will be forwarded to the Board of Commissioners, which will consider final action on June 1. Neighbors who raised operational and environmental concerns were told the appropriate next steps include filing complaints with county code enforcement so staff can investigate the allegations.
