Planning Commission forwards Penica subdivision, tables multiple development plans

The Silver Spring Township Planning Commission on June 6, 2024, voted to forward the Jay and Dyana Penica final subdivision (2024-4) to the Board of Supervisors with a recommendation for conditional approval provided all staff and stormwater comments are satisfied.
Engineer Joe Burget presented the Penica plan, which consolidates three tracts into a larger parcel and creates one additional lot for a single-family home. Community Development Director Chris Guarino told the commission that staff’s comments are minor if the applicants file the additional waivers discussed at the meeting. HRG engineer Maitlin Greiner recommended waivers covering a private road and a joint-use driveway and said HRG would be comfortable recommending conditional approval if the township engineer and the applicant address stormwater comments.
The meeting record notes a carbon assessment test is underway and an abandoned right-of-way for an unused power line runs through the property. Commissioners discussed maintenance of the private road/right-of-way and Act 75 implications; the Penicas and the buyers of the rear lot agreed to execute and record a maintenance agreement. Commissioner Doug McDonald expressed concern about the width of the access lane for emergency vehicles and water supply, and asked the applicants to consider widening the lane to 12 feet or adding a stone shoulder.
On the consent and motions recorded for the evening, the commission tabled three applications after the applicants requested postponements: Kost Road Tract (2023-8) preliminary plan, Silver Spring Storage (2024-2) preliminary/final plan, and Trindle Spring Trade Center (2024-1) preliminary/final plan. The conditional use application for 264 Ridge Hill Road (CU2024-3) was also tabled at the applicants’ request. All of these procedural actions were approved on McDonald/Sandys motions and recorded as "motion carried" in the meeting minutes.
What happens next: the Penica subdivision will go to the Board of Supervisors with the Planning Commission’s recommendation for conditional approval; the plan remains contingent on satisfying all engineer and stormwater comments and any required waivers. The tabled land development applications remain pending until applicants return or reschedule their submissions with the commission.
