Planning Commission recommends repeal-and-replace of DMC 14.08 permit-processing code

The Duvall Planning Commission on April 8 voted to recommend that the City Council repeal and replace Duvall Municipal Code Chapter 14.08, a staff presentation said, to standardize and update permit-processing timelines and consolidated review categories.
Associate Planner Maddie Lawrenson told the commission the proposal is "a complete repeal and replace of the existing 14.08 chapter" and that the updates respond to Senate Bill 5290 (2023). She outlined proposed processing timelines: "when a project permit does not require public noticing, 65 days; when a project permit requires public noticing, 100 days; and when a project permit requires public noticing and a hearing, 170 days." Lawrenson said the changes also remove elements unrelated to land-use permit processing and clarify which permits are covered by the chapter.
The presentation noted that a SEPA (State Environmental Policy Act) determination of non-significance will be issued on Monday and that consultant BHC and a consultant named Abby assisted in drafting and reviewing the amendments. Lawrenson said staff had not received written public comments on the proposal prior to the hearing and that the public hearing before the commission would inform the commission's formal recommendation to the council. The staff report and associated exhibits were made available in the commission packet and on the city's website.
There was no in-person public testimony at the commission hearing. With no speakers present and no written comments submitted, the commission closed the public hearing at 6:18 p.m.
Commissioner Chapel moved to recommend the repeal-and-replace of DMC 14.08 and associated code amendments in Titles 2, 9 and 14 to the City Council; the motion was seconded and passed by voice vote. The transcript records the motion and a voice vote but does not provide a roll-call tally or identify the member who seconded the motion.
City staff also provided updates on several development applications under review — including the Acres of Diamond site-plan resubmittal, Main Street Development (clearing and grading permit in engineering review), Skylight Ridge East/West and Baton Creek — and shared upcoming community events, including a State of the City and community budget workshop on April 16 and a community coffee with Udub students and the Holy Duvall Festival on April 25.
Next steps: the Planning Commission's recommendation will be forwarded to the City Council, which is scheduled to hold its public hearing on the code amendments on April 21. Staff expects to issue the SEPA determination the Monday following the commission meeting.
