Planning commission forwards definition amendments, tables conditional‑use overhaul for more study

On April 7 the Planning Commission voted to forward a comprehensive package of updated zoning definitions (Exhibit A) to the City Council with a positive recommendation and to continue the more complex task of eliminating and reworking conditional uses to a subsequent meeting.

Staff presented dozens of revised or new definitions intended to clarify terms used across the municipal code (examples listed in Exhibit A included petting farm, park and ride, nursery/greenhouse, classes, and more). Commissioners agreed the revised definitions would assist applicants and reviewers; the motion to send Exhibit A to council carried with a positive recommendation.

Separately, commissioners discussed the longstanding difficulties with "conditional uses"—uses that require discretionary approvals and conditions to address reasonably anticipated detrimental impacts. Legal staff reminded the commission that conditions must be tied to identifiable harms the code seeks to mitigate, and that poorly defined conditional use provisions can invite litigation. Because rewriting the permitted‑use table and removing or replacing conditional uses is a complex, cross‑referenced task, the commission voted to continue that item to the next month to allow more focused review and to provide staff the time to attach existing conditions and references to the worksheet used by commissioners.

Next steps: Exhibit A (the definitions package) will go to City Council for adoption consideration. The permitted‑use and conditional‑use rewrite will return to the commission after staff prepares a clearer matrix of existing conditions and recommended replacements.
