Board approves variance for pool within Ordinary High Water Level structural setback

The Wabasha County Board of Adjustment on May 12 approved a variance allowing a structure within the structural setback from the Ordinary High Water Level (OHWL) at 67504 County Road 76 (parcel R05.01428.00) in Section 2, Township 110 North, Range 10 West of Greenfield Township. The motion passed 4-0.
The board opened a public hearing on the request by Steve and Shelley Jech under Wabasha County Ordinance Chapter 13.07(3)(b). Steve Jech presented the application. The board approved the request with two conditions: the landowner must abide by all representations and commitments presented in the application or to the Board of Adjustment; and a Building & Land Use Permit must be obtained and approved by Wabasha County and its contracted building inspector for the construction of the pool and any associated retaining walls. The motion to approve was made by Patrick Judge and seconded by Mike Wallerich; motion carried 4-0.
The approval is limited to the plans and representations submitted to the board; required county permits and contracted inspection approval must be secured before construction may proceed. The Planning Commission meeting originally scheduled for May 26 was canceled; the BOA's next meeting is June 9, 2026.
